Being arrested for DWI is extremely costly in more than financial terms. It is a life-altering event that can affect everything from getting a job to getting a loan. How do you know if the lawyer you select can successfully defend a DWI law proceeding? Find out if the attorney has had any prior disciplinary actions. Also check to see if they are actually licensed to practice DWI law. Consult with your state’s Bar association. They can tell you if the attorney is in good standing and if they are currently licensed. Better yet, when you shop for an attorney, the state Bar association is a fantastic first stop. They can refer you to a licensed attorney in good standing that specializes in DWI law. Plus, if you contact the Bar association first, you might be eligible for a free or low-cost initial consultation with the DWI law practitioner. Check the attorney’s fee structure. Most lawyers who practice DWI law earn their fees on a flat fee basis. Sometimes, staged or hourly billing might be more appropriate depending on the situation. In either case, ensure that the attorney does not charge on a “contingency” basis, as Bar association guidelines prohibit this. Keep in mind, though, that more experienced attorneys will charge significantly more than their younger and less experienced counterparts. If you find that one attorney charges seemingly unreasonable fees over other experienced attorneys, find out why. Perhaps their winning percentage is legendary. On the other hand, an attorney charging unusually low fees will often yield undesirable results. The current caseload of your potential attorney should also be considered. Some lawyers will do no more than “plead” a case, never going to trial. Going to court and defending a case is exponentially more time-consuming than entering a guilty plea. A good trial lawyer limits the DWI law caseload to a handful so that the appropriate attention can be given to each client. Of course, one of the better ways to find out the competency of a lawyer is through his or her references. When speaking with references, determine what kind of work the lawyer did with that client. A successful trial defense carries much more weight than a client who commends the “speedy handling and resolution” of a DWI case. That could amount to nothing more than a guilty plea. You might even choose to speak with other attorneys who do not handle criminal cases. They have the inside scoop on your market area and can speak to the reputation of other lawyers.
